General Terms

These terms and conditions and all transactions relating to this website are governed by English law and are subject to the non-exclusive jurisdiction of the English courts. We do not accept amendments to these terms and conditions. Additional terms and conditions may apply for prize competitions, pre-release orders and our added value services and offers. If so, you will be alerted to them at the relevant juncture. These terms and conditions only cover the vantainer.com website. Any other websites which are linked to from this site are governed by their own terms and conditions. We accept no responsibility or liability for the content or operation of websites, which are not under our control. We are required by law to tell you that sales can be concluded in English only and that no public filing requirements apply.

The Contract

By placing an order with Vantainer Ltd, you confirm that you are entering into binding contract. We reserve the right at our sole discretion not to accept any order. The contract comes into effect once your order is confirmed and accepted by us, under the terms and conditions set out here.

Any contract for purchases made through the website will be with Vantainer Ltd. VanTainer must receive payment in full for the goods that you order before your order can be accepted, and the contract formed. Once payment has been received VanTainer will confirm that your order has been received by sending an email to you at the email address you provide in your registration form. The delivery email will include your name, the order number and the total price. Our acceptance of your order brings into existence a legally binding contract between us on these terms. Any term sought to be imposed by you in your order will not form part of the contract.

VanTainer is entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the goods appearing on our website. If an error or inaccuracy is discovered with regards to the advertised price of the goods that you have ordered, we will contact you as soon as possible by e-mail. This will be to inform you of the correct price of the goods, and to ask you if you wish to continue with the order at the amended price, or to cancel the order altogether.

These Conditions do not affect the statutory rights as defined by the Unfair Contract Terms Act 1977 and/or the Sale of Goods Act 1979 and/or the Unfair Terms in Consumer Contracts Regulations 1994 and 1999 or by any statutory modification of any Acts or Regulations.

No rights whatsoever in respect of these Conditions shall attach to any third party within the meaning of the Contracts (Rights of Third Parties) Act 1999 or of any statutory modification of that Act.

The Website

VanTainer own the copyright, trademarks and other intellectual property rights in all material and content on this website, which you may use, download, copy, publish, transmit or otherwise make available by any other means only for your own personal, non-commercial use. Any other use or reproduction of the material or content is strictly prohibited. While we will use reasonable endeavours to verify the accuracy of any information, we place on the VanTainer website, we make no warranties, whether express or implied in relation to its accuracy. The Company's policy of continuous improvement determines its right to change specifications and/or prices without notice.

We make no warranty that the VanTainer website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, and reliability of the website. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the VanTainer website.

Payment methods currently accepted are: PayPal, Credit & Debit cards, Bank Transfer or cash on collection. We NEVER store credit card details nor do we share customer details with any 3rd parties. All product prices and delivery charges are shown in UK pounds sterling with VAT quoted at the prevailing rate at the time of dispatch of the goods.

The Goods

VanTainer aims to keep all items advertised on the web site in stock at all times, if an item is no longer in stock or available then we will endeavour to update the web site as soon as possible. If you have ordered an item that is out of stock, we will email you to let you know and offer an alternative if available or give lead times for stock replenishment. If no alternative is available or you do not want the alternative then you will be offered the opportunity of a refund and notification of when new stock is available. If part of your order is out of stock and you still want to go ahead with the order then the outstanding item/s will be sent at no extra cost to you.

Delivery & Returns

We will endeavour to deliver the goods as soon as is practicable, any delivery date or time frame is given is for guidance only and does not form part of these conditions.

We shall supply the goods to our delivery company in good order, but will not be held liable for the condition of the goods delivered to your chosen delivery address.

You the customer are responsible upon receipt of the goods for checking the accuracy of the quantities delivered and their quality and condition.

In every case of a shortage or if there is any damage to the goods you should make this known to the carrier, and where possible endorse their documentation accordingly. In such event and where possible you should notify us immediately by phone. We will only accept notification of delivery issues on receipt of goods, withing 3 working days of goods being received by you.

Having been notified by you we may require proof of any shortage or damage to the goods. Once we are satisfied with any alleged issues, we will endeavour to rectify the situation to your satisfaction, by fulfilling any shortage, or offering a replacement, or credit.

VanTainer is committed to protecting your privacy, and at the same time we endeavour to use any data we collect from you to provide the best possible service. We respect your privacy and comply with the General Data Protection Regulations in respect of your personal information.

In respect of these Terms and Conditions:

• Data Protection Law’s means any law relating to personal data, including but not limited to GDPR.
• “GDPR” means: General Data Protection Regulations and is governed in the UK by The Data Protection Act 2018
• Personal Data you provide to us is used in order that we can supply goods to you and process your order, in so doing we shall comply with any data protection laws.

VanTainer will use the data you supply to answer an enquiry or to administer an ongoing commercial relationship. We may also use your data to tell you about changes to the site, new information, or products and services offered by VanTainer that we think you will find valuable. You can choose not to receive this information by sending an email to sales@vantainer.com with the subject 'No information'.

VanTainer respects the privacy of its customers. We will never share, sell, trade or rent your personal data. 

Cancellations

If you are a UK Consumer you have the right to cancel your order from the moment your order is placed with us and ends 14 days from the day the goods are received by you. Should you wish to cancel an order you must notify us, specifying the number of the order you wish to cancel.

You may only exercise this right to cancel your order if the goods are in a re-saleable condition with their original packaging.

• You must return the goods to us at your own cost and risk, within 14 days of notifying us that you wish to cancel your order. This excludes where we are at fault, in which case we will arrange collection at our cost.
• You may wish to insure your returned goods against damage or loss, as we accept no liability for goods being returned to us.
• While in your possession you are responsible for the care of the goods.

VanTainer will refunded the monies within 14 days of such cancellation of the goods being received by us, or by you providing evidence of having returned the goods, whichever is the sooner.

For goods delivered outside the United Kingdom, our Returns Policy does not apply.

We are committed to providing the highest level of service to our customers. We welcome comments, feedback and suggestions so that we may continually improve the way in which we do business.

If you are not happy with a product or service from us then please contact us straight away by telephone or email. We will endeavour to resolve any problems straight away or as soon as reasonably possible.

We will endeavour to respond within 24 hours and resolve the issue straightaway. If this is not possible, we will keep you informed of what action we are taking and any timescales. If you write to us, we will try to make contact with you within 3 working days of receiving the letter.

Vantainer Ltd reserves the right to make changes to our site, policies, and these terms and conditions at any time. If any of these conditions shall be deemed invalid, void, or for any reason unforeseen, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
